Terms of Service
Last updated: . Effective: .
These terms are the agreement between you and Photobooth Pricing (“we”, “us”) for using our website and app at photoboothpricing.com. Please read them. They include a limit on our liability in section 12.
1. Accepting these terms
By creating an account or using Photobooth Pricing, you agree to these terms and to our Privacy Policy. If you use the service for a business, you confirm that you are allowed to accept these terms for that business, and “you” includes the business.
If you do not agree, please do not use the service.
2. The service
Photobooth Pricing helps photo booth businesses track their costs, build packages and calculate prices. It is a business tool. You must be at least 18 years old to use it, and you must use it for business purposes, not personal or household use.
3. Beta and pricing
The service is currently in open beta and free to use. Features may be added, changed or removed during the beta.
If we introduce paid plans, we will announce the pricing before it applies to you. We will not charge you unless you choose to subscribe.
4. Accounts and team members
- Give accurate information when you sign up and keep it up to date.
- Keep your password and sign-in secure. You are responsible for activity on your account.
- Tell us right away at [email protected] if you think someone has accessed your account without permission.
Every account works inside a studio. The studio owner can invite team members, choose their roles and permissions, and remove them. The studio owner is responsible for their team’s use of the service, for the access they grant, and for having a business reason to send invitations to the email addresses they enter.
5. Acceptable use
You agree not to:
- break the law, or use the service to infringe anyone else’s rights;
- try to access accounts, studios or data that are not yours, or get around our security, permissions or rate limits;
- overload, disrupt or attack the service, or use automated tools to access it except through our API or a connected app you authorize;
- upload malware, or content you do not have the right to use;
- use team invitations to send spam or unwanted email; or
- resell or rent access to the service without our written permission.
6. Your data
Your studio owns its data. That includes your items, costs, packages, descriptions, settings, images and everything else you enter or upload.
You give us a limited licence to store, copy, process, display and transmit your data only as needed to run, secure and support the service for you, including sending it to connected apps you approve and publishing a catalog when you choose to. We do not sell your data.
You are responsible for your data: that it is accurate, that you have the right to use it, and that any personal information in it was collected lawfully. Our Privacy Policy explains how we handle personal information.
If you send us feedback or suggestions, we may use them without any obligation to you.
7. Connected apps and the API
You can connect third-party apps, such as Claude through our Claude connector, and studio owners and admins can create API keys. When you do:
- You are responsible for what you authorize. A connected app or API key can read, and if you allow it, change or delete, data in the studio you chose, within your role’s permissions. Actions it takes are treated as actions taken by you.
- AI assistants can make mistakes. Review what a connected app proposes before you confirm a change, and check your data after.
- Third-party apps are run by their own providers under their own terms and privacy policies. We are not responsible for them or for what they do with data you send them.
- Keep API keys secret. You can disconnect apps under Connected apps in the app at any time.
- We may limit request rates, or suspend or revoke a connection or key, to protect the service or other users.
8. Prices and AI drafts are not advice
The prices, costs and margins the app shows are calculations based on the numbers you enter, such as your costs, markups, overhead, event counts and labor rates, and on exchange rates from a public source that may lag the market. The results are only as accurate as those inputs.
The app is not financial, accounting, tax or legal advice, and we do not guarantee that any price will be profitable or competitive. Check the numbers before you quote a client or publish a price. You are responsible for the prices you charge.
AI-written descriptions
Auto-generate writes draft package descriptions with AI. Drafts can be wrong or describe things your package does not include. Review and edit each draft before you save or publish it. You are responsible for the descriptions you use.
9. Published catalogs
You can choose to publish your package catalog so your website can show it. A published catalog is public: anyone with its web address can read it. You are responsible for what it shows, including package descriptions, images and prices, and for any deploy hooks you add.
You can unpublish at any time. We may remove a published catalog that breaks these terms or the law.
10. Our software
We own the Photobooth Pricing app, website, software and design. While you follow these terms, we give you a personal, non-exclusive, non-transferable right to use the service for your business. You may not copy, modify or reverse engineer it, except as the law allows.
11. Availability and “as is” service
We work to keep Photobooth Pricing reliable, but the service is in beta and is provided “as is” and “as available”. To the extent the law allows, we make no promises or warranties about the service, including that it will be uninterrupted, error-free or fit for a particular purpose, or that calculations will be free of errors.
The service may be unavailable at times, for example during maintenance or outages. Keep your own records of the prices you quote.
12. Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business opportunities or data, even if we were told they were possible; and
- our total liability for all claims relating to the service is limited to the greater of the amount you paid us for the service in the 12 months before the claim, or CAD $100.
Nothing in these terms limits liability that cannot be limited under the law that applies.
13. Ending your use, data export and deletion
You can stop using the service at any time. You can delete your account under Delete Account in the app. For each studio you own that has other members, you choose to make one of them the owner or to delete the studio. Everything else you own is deleted with your account. To get a copy of your data first, email [email protected]. Our Privacy Policy explains what we keep and for how long.
We may suspend or end your access if you break these terms, if needed to protect the service or other users, or if the law requires it. If we decide to shut down the service, we will give reasonable notice so you can request a copy of your data.
Sections 6, 8, and 11 to 16 continue to apply after your use ends.
14. Changes to these terms
We may update these terms as the service changes. We will post the new version here and change the “Last updated” date. If we make a significant change, we will let account holders know by email or in the app before it takes effect. If you keep using the service after that, you accept the updated terms.
15. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and we agree that the courts of Ontario have exclusive jurisdiction over any dispute about these terms or the service.
16. General
- These terms and our Privacy Policy are the whole agreement between you and us about the service.
- If part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a term right away, we can still enforce it later.
- You may not transfer these terms to someone else without our consent. We may transfer them to a business that takes over the service.
